The petitioner is apprehending his arrest in a case registered for the offence punishable under sections 419, 420 and 467 of the Indian Penal Code.

Prosecution case is that one Ranjan Kumar was appearing in place of petitioner, Samir Akhtar at the Matriculation Examination.

It is submitted by the learned counsel for the petitioner that the petitioner was not aware of Ranjan Kumar appearing in his place. Though the case was registered in the year 2013 but the petitioner was not aware of his involvement in the case. Even assuming the case to be true, at best a case under section 419 of the Indian Penal Code is made out, which is bailable. Keeping in view the aforesaid facts, it is a case for consideration of the prayer for regular bail.

Patna High Court Cr.Misc. No.24450 of 2016 (4) dt.15-07-2016 Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Warsaliganj P.S.Case No. 25/2013 pending in the court of S.D.J.M., Nawada.

With the aforesaid observation, this application is disposed of.
