The petitioner is in custody since 03.09.2016 in connection with Maharajganj P.S.Case No.171 of 2016 registered for an offence under Sections 302 and 120(B)/34 of the IPC. The case registered on the basis of the fardbeyan of mother of the deceased. It has been alleged that this petitioner and three others who are named in the FIR, conspired and committed murder of her son as well as Sabita Kumari, the sister of the coaccused Rajesh Sharma. The learned counsel for the petitioner submits that the petitioner has been made accused merely on suspicion only for the reason that he happens to be agnate of co-accused Rajesh Sharma and others. Patna High Court Cr.Misc. No.11793 of 2017 (2) dt.18-03-2017 @ Hirdya Lal Sharma had affairs since before and both of them were found dead together in suspicious condition also the father of the deceased Sabita Kumari has been allowed bail by the coordinate Bench of this Court on 28.01.2017 vide Cr.Misc.No.54817 of 2016. The case of this petitioner stands on better footing as he has no concern with the other co-accused. The learned APP opposed the submissions.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-V, Siwan in Maharajganj P.S.Case No.171 of 2016.
