JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 All the above stated petitions arise out of Barauni P.S.Case No. 128 of 2009 registered under section 406, 409, 420, 467, 468/34 of the Indian Penal Code and accordingly, all the above stated petitions are being disposed of by this common order. Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner in Cr. Misc. No. 22955 of 2014 was posted as General Manager cum Chief Engineer, Barauni Thermal Power Station for the period 10.11.2006 to 02.04.2007. Petitioner in Cr. Misc. No. 25655 of 2014 was posted as Account Officer between the periods 05.09.2002 to 2006. Petitioner in Cr. Misc. No.
26565 of 2014 was posted as Deputy Director of the head quarter. In course of investigation, it came to light that the then accountant received the amount in question but did not make proper entry in the relevant registers and the accountant brought the relevant registers at his home but unfortunately he was murdered for which a criminal case was registered and the concerned registers were seized by the police.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Barauni P.S.Case No. 128 of 2009, subject to condition as laid down under Section 438(2) of the Cr.P.C.
