Though the petitioner complains against the report of the Appropriate Authority -cum- Divisional Forest Officer, Munger dated 23.8.2012 as contained in Annexure-4, whereby the Appropriate Authority -cum- Divisional Forest Officer, Munger has intimated the Chief Judicial Magistrate, Munger that a confiscation proceeding has been initiated by him under the provisions of section 52 of the Indian Forest Act, 1927 but the communication is only informatory in nature.

Mr. Singh, learned counsel appearing for the petitioner informs that the confiscation proceeding was initiated way back in

Patna High Court CWJC No.14599 of 2013 dt.15-09-2017 2012 yet remains pending that is the cause of grievance. Having heard learned counsel for the parties and considering that the confiscation proceeding initiated as back as in the year 2012 according to the petitioner yet remains pending, I deem it proper to dispose of the writ petition with a direction to the Appropriate Authority -cum- Divisional Forest Officer, Forest Division, Munger to consider and dispose of the confiscation proceeding in accordance with law and after due opportunity of hearing to the petitioner within a period of three months from the date of receipt/production of a copy of this order in case the confiscation proceeding remains pending.
