This criminal miscellaneous has been filed for modification in the order dated 20.02.2017 passed in Cr. Misc. No. 3317 of 2017 by which the petitioner was admitted to bail in S. T. No. 782 of 2013 arising out of Muffasil P.S. Case No. 259 of 2003 to the satisfaction of learned Additional Sessions Judge 5th, Munger with a direction to remain present on each and every date during trial. The petitioner is serving in NDRF at Chennai and it is not possible for him to remain present physically on each and every date.

Heard and perused the order dated 20.02.2017 passed in Cr. Misc. No. 3317 of 2017 in which there is no direction to remain present physically, there is only direction to remain present, that may be through learned advocate also and as such

Patna High Court Cr.Misc. No.15188 of 2017 (2) dt.29-03-2017 there is no need to modify that order and accordingly, this modification application is hereby disposed of with the aforesaid observation.
