The petitioners seek bail in Alam Nagar P.S. Case No. 86 of 2016, registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code, under Sections 25(1-b)a, 26 and 35 of the Arms Act and under Section 47(a) and 53(a) of Bihar Excise (Amendment) Act, 2016.

The police raided the place on information that some criminals had assembled to commit cognizable offence. Md. Nijam @ Mantu and Jitendra @ Jito Singh were apprehended and they are said to have disclosed names of the petitioners, but the petitioners were not arrested on the spot and nothing has been recovered from the possession of the petitioners. The petitioners are in jail since 02.12.2016. The petitioners have already remained

Patna High Court Cr.Misc. No.14952 of 2017 (2) dt.19-04-2017 2/2 in jail for more than 41⁄2 months.

Considering the facts aforesaid the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in Alam Nagar P.S. Case No. 86 of 2016.
