The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/120B of the Indian Penal Code and sections 63, 65 and 68 of the Copy Right Act.
Prosecution case is that police raided and recovered some packets of Biri of different brand from the factory of the petitioner.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case because of ulterior motive. Petitioner is the proprietor of Milan Biri Factory No.1 Asli Hira and has no concern with
Patna High Court CR. MISC. No.54453 of 2022(2) dt.22-12-2022 2/2 alleged recovery of biri of Ajhar Biri Factory. Petitioner pays GST over his brand and thus he has committed no offence under the Copy Right Act. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Araira in Araria Police Station Case No. 293 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
