The petitioner apprehends his arrest in connection with Kahalgaon (Ghogha) P.S. Case No.385 of 2015 registered under Sections 366(A), 341, 323 and 504/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Bhagalpur. The accusation against the petitioner is of kidnapping the minor daughter of the informant with the help of his other family members.

Submission is that, in fact, the victim moved from the house according to her own sweet will and performed the marriage with this petitioner on 01.09.2015 at Brajleshwar Nath Mahadev

Patna High Court Cr.Misc. No.26964 of 2016 (4) dt.31-08-2016 2/2 Mandir Trust, Village and Post-Marwa, P.S. Bihpur, DistrictBhagalpur, and she used to reside with the petitioner as wife and husband.

Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
