JUSTICE RAKESH KUMAR ORAL ORDER 08-09-2016 Heard Sri Ajay Mukherjee, learned counsel for the petitioner and Sri Atul Chandra, learned A.P.P. The sole petitioner, who is named as accused in Rajoun P.S. Case No. 13 of 2016 registered for the offence under section 341, 323, 324, 307, 379, 504 , 506 /34 of the Indian Penal Code has prayed for grant bail in the event of his arrest. It was submitted by learned counsel for the petitioner that it is true that petitioner has been arrayed as accused in the F.I.R. with an accusation that he was order giver , there is no allegation of committing any overt act by the petitioner. He further submits that on perusal of the F.I.R. itself it is evident that there was dispute in between the parties in which petitioner has been implicated due to village politics. Learned counsel for the
Patna High Court Cr.Misc. No.34524 of 2016 (2) dt.08-09-2016 2/2 petitioner further submits that injury report does not corroborate the allegation and it does not attract Section 307 of the Indian Penal Code.
However keeping in view the fact that petitioner is one of the named accused with allegation of order giver, I do not find it a case for extending the privilege of anticipatory bail. The petition stands dismissed.
