The present application has been filed for modification of the order dated 15.03.2018 passed in Cr.Misc.No. 12290 of 2018, by which the petitioners were granted anticipatory bail in connection with Complaint case No.305 of 2017 pending in the court of C.J.M., Bhagalpur.
It is submitted on behalf of the counsel for the petitioners that due to inadvertence in paragraph 6 as well as prayer portion of the bail application i.e. Cr.Misc.No.12290 of 2018,
Patna High Court Cr.Misc. No.25237 of 2018(2) dt.26-04-2018 2/2 designation/name of the court has wrongly been mentioned as 'Chief Judicial Magistrate, Bhagalpur', in place of 'S.D.J.M., Naugachhia' and as such the same mistake crept up in the order dated 15.03.2018 passed in Cr.Misc.No.12290 of 2018. It is therefore prayed on behalf of the counsel for the petitioners that necessary correction be made with regard to designation/name of the court and also made prayer to grant further six weeks time to surrender and furnish bail bond. In view of the above, let the words 'Chief Judicial Magistrate, Bhagalpur' mentioned in the order dated 15.03.2018 passed in Cr.Misc.No.12290 of 2018 be read as 'S.D.J.M., Naugachhia'.
As prayed for, the time to surrender and furnish bail bond is also extended by a further period of six weeks from the date of receipt/production of a copy of this order. The order dated 15.03.2018 passed in Cr.Misc.No. 12290 of 2018 stands modified to the extent indicated above. The modification application is, accordingly, disposed of.
