JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Karandey P.S. Case No. 05 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 379, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution story is that petitioners along with other co-accused persons came variously armed and surrounded the informant and on the order of Kapil Yadav, petitioner No.1 and one Karu Yadav assaulted him by lathi on his leg. Further allegation is that other petitioners thrashed him on the ground and snatched Rs.25,000/- from his pocket.

No.52327 of 2019(2) dt.22-08-2019 2/2 Submission of learned counsel for the petitioners is that here is dispute with respect to drainage and there is case and counter case between the parties and further submission is that there is injury report available on the record. Heard learned APP also.

In view of above facts and circumstances, let petitioners surrender in the court below by 29.8.2019 and on surrender he shall be released on provisional bail by the court below and in the meantime learned court below shall peruse the case diary and if it is found that injuries are simple in nature, the provisional bail shall be confirmed, otherwise the petitioners to surrender and pray for regular bail.

With the above observation this application is disposed of.
