JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 307, 324, 147, 149 of the Indian Penal Code and 3 / 5 of Explosive Substance Act.
Accusation is that due to land dispute the petitioner along with Prasadi Yadav, Mahesh Yadav, Naresh Yadav, Baliram Yadav and Ghanshyam Yadav armed with Bomb came at the door of the informant and hurled the bomb on the informant. They also hurled bombs in his Angan in which two cattles of the informant sustained injury. The son of the informant also sustained slight bomb injury at his thigh.
Submission is that there is general and omnibus allegation against the petitioner and other accused hurled the
Patna High Court Cr.Misc. No.20066 of 2017 (2) dt.10-05-2017 2/2 bomb. The injury, as found, on the thigh of the son of the informant is simple in nature. Further submission is that the petitioner has got no criminal antecedent and he is in jail custody since 20.04.2016.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1,Banka in S.T.No. 104 of 2016 arising out of Dhoraiya P.S.Case No. 63 of 1999.
