JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-05-2018 The petitioner seeks bail in anticipation of his arrest in connection with Parihar P.S. Case No. 243 of 2017, dated 21.12.2017, instituted for the offences punishable under Sections 147, 149, 188, 283, 291 and 353 of the Indian Penal Code.

The petitioner is said to have led a mob of some people and had, on the date of the occurrence, disturbed the even flow of the traffic.

Learned counsel for the petitioner has submitted that he has been made accused in this case purposely

Patna High Court Cr.Misc. No.25598 of 2018 (2) dt.04-05-2018 2/2 because he happens to be member of a political party, which is not in the government. It has also been submitted that from the narration in the First Information Report, no offence either under Sections 353 or 283 of the Indian Penal Code can at all be said to have been made out against the petitioner.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned I/c Chief Judicial Magistrate, Sitamarhi in connection with Parihar P.S. Case No. 243 of 2017.
