JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 Petitioner is languishing in custody since 16.09.2013 in a case registered for the offences punishable under Sections 147, 148, 149, 307, 354, 385, 387 of the I.P.C. It is alleged that twelve accused persons resorted to firing for non-fulfilment of extortion demand in which several persons received injuries.
It is submitted by learned counsel for the petitioner that accusation is not specific against the petitioner and other co-accused have been granted bail vide Cr. Misc. No. 38488 of 2005.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.25152 of 2014 (4) dt.08-01-2015 2/2 amount each to the satisfaction of learned Adhoc Additional Sessions Judge-V, Muzaffarpur in connection with Sessions Trial No. 82 of 2012, arising out of Paroo P.S. Case No. 84 of 2004.
Since in a case instituted in 2004 the petitioner has been arrested in 2013, let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during trial. (Dinesh Kumar Singh, J) Shageer/- U T
