The petitioner apprehends his arrest in Munger Muffasil P.S. Case No. 225 of 2015 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
The informant alleged that he went to his field with pumping set to irrigate his land but Pappu Chaudhary and Vyas Yadav abused the informant and opened fire. They threatened the informant to kill if he continues to irrigate his land. Learned counsel for the petitioner submits that name of the petitioner was inserted in the fardbeyan as leader of the gang but the petitioner was not even present.
Considering the facts aforesaid and the fact that no allegation is made against the petitioner and it is alleged that the
Patna High Court Cr.Misc. No.48885 of 2016 (2) dt.16-12-2016 2/2 petitioner is the leader of the gang, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Munger in Munger Muffasil P.S. Case No. 225 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
