This is a petition for grant of regular bail for offences under Sections 461, 379, 411, 414 and 34 of the Indian Penal Code.

From the auto-rickshaw of the petitioner, a stolen battery was allegedly recovered.

Submission of the petitioner is that the petitioner was driver of the auto-rickshaw and some other coaccused were also riding in the same auto-rickshaw. The petitioner has sated on oath that he has got no criminal antecedent and is in custody since 25.01.2017, wrongly mentioned in paragraph 11 of the bail petition as 17.01.2017.

Considering the aforesaid fact, the petitioner,

Patna High Court Cr.Misc. No.18339 of 2017 (2) dt.24-04-2017 2/2 above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Supaul P.S. Case No. 52 of 2017 to the satisfaction of the Chief Judicial Magistrate, Supaul, or successor Court.
