The petitioners apprehend their arrest in connection with Agamkuan P.S. Case No. 430 of 2022 for the offence registered under Sections 341, 323, 290, 354, 379, 506, 324/34 of the Indian Penal Code.
As per the prosecution story, the petitioners in drunken state created nuisance in their locality which was being opposed by the informant's husband. Infuriated by that, they assaulted her husband causing injuries to him which according to the
Patna High Court CR. MISC. No.56412 of 2022(2) dt.23-01-2023 2/2 observation of learned Session Judge were found to be grievous in nature.
Considering the aforesaid allegation that has come against the petitioners of firstly making nuisance in inebriated state and thereafter on protest assaulting the informant's husband, this Court does not deem it fit to extend them the privilege of anticipatory bail which is accordingly rejected.
