JUSTICE ARUN KUMAR ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Jogapatti (Sanichari) P.S. Case No.314 of 2016 registered under Sections 147, 148, 149, 341, 323, 324, 504 and 302 of the Indian Penal Code.
Allegation in brief is that all accused persons turned up armed with lathi and piece of bamboo and on the extortion given by Khedu Mian, Chotak Mian gave bamboo blow over the head of the deceased, thereafter, others also assaulted him. Learned counsel appearing on behalf of the petitioner submits that the petitioner and the informant are neighbours, however, the specific allegation of hitting on the head which became fatal according to the postmortem report is against Chotak
Patna High Court Cr.Misc. No.22836 of 2017 (2) dt.14-06-2017 2/2 Mian and there are general allegations against the petitioner; according to the postmortem report, the sole head injury alleged to be given by Chotak Mian was cause of his death. This petitioner has been in custody since 11.11.2016 and charge sheet has been submitted in this case and has got no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Kariman Mian is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bettiah, West Champaran in connection with Jogapatti (Sanichari) P.S. Case No.314 of 2016.
