The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that he along with other co-accused surrounded the husband of the informant and all the miscreants shot fire upon her husband and after firing they all fled away.

Earlier the bail application of the petitioner was rejected vide Annexure-1 series to the present application. This is the third attempt on behalf of the petitioner for grant of bail.

Patna High Court Cr.Misc. No.20173 of 2017 (3) dt.17-05-2017 2/2 A report was called for from the trial court regarding the stage of the case. It has been reported that the case is fixed for statement of the accused under Section 313 of the Cr.P.C. The trial is expected to be concluded within a period of four months, if the parties co-operate.

Considering the aforesaid facts and stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in S.T. No. 267 of 2015, arising out of Bakhari P.S. Case No. 139 of 2014, pending in the court of learned A.D.J.-II, Begusarai.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of four months from the date of receipt/production of a copy of this order. It is expected that both the parties shall co-operate during the proceedings of the court.
