JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Daruli P.S. Case No. 28 of 2019 registered for the offences punishable under Sections 341, 323, 353, 504 and 506 of the Indian Penal Code.

Prosecution case is that when the officials of electricity department came to the house of one Kanhaiya Tiwary for getting the line disconnected due to non-payment of bill, they were abused and threatened by the accused persons, including the petitioner.

Submission of learned counsel for the petitioner is that FIR itself shows that bill amount has been deposited and the allegation is false and concocted.

In view of above facts and circumstances, this application is disposed of with a direction to the learned court below to verify as to whether the due bill amount has been deposited and once the court below is satisfied with the same, the petitioner shall be released on bail to its own satisfaction.
