JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 307/302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is there against twelve persons to have committed assault and fire causing death of Abhilakh Sahani. The doctor has found single fire-arm injury on the person of the deceased.

Similarly situated some other co-accused have been allowed anticipatory bail as well as regular bail by different coordinate Benches of this Court.

Considering the facts and circumstances, let

Patna High Court Cr.Misc. No.18472 of 2017 (2) dt.25-04-2017 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XIII, East Champaran, Motihari/Successor Court, in connection with Pakridayal P.S. Case No.97 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
