The petitioners apprehend their arrest in Kasim Bazar P.S. Case No. 100/2016, registered for the offences punishable under Section 47 of the Bihar Excise (Amendment) Act, 2016. The police raided a dilapidated house of Chhotu Sharma and from there 74 bottles of Royal stag each containing 750 m.l., 24 bottles of Royal Stag each containing 375 m.l. and 08 bottles of Blenders Pride each containing 750 m.l. were recovered. Chhotu Sharma disclosed that both the petitioners had kept wine in the house.

It is submitted that petitioners were not arrested on the spot. Nothing has been recovered from the possession of the

Patna High Court Cr.Misc. No.49102 of 2016 (2) dt.16-12-2016 2/2 petitioners. Chhotu Sharma named the petitioners in order to save himself.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No. 100/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
