This application is for grant of regular bail in connection with Sangrampur P.S.Case No.146 of 2015 for the offences under Sections 302, 201 and 120(B)/34 of the Indian Penal Code. The petitioner is not named in the F.I.R. and later on during the course of investigation, one blood stained petticoat and one blood stained sac of cement were recovered from the house of the petitioner.
It is submitted on behalf of the petitioner that father of the petitioner had lodged 'Sanaha' earlier to this case, as such, under the conspiracy, he has been falsely implicated in this case by the brother of the petitioner for the purpose to grab the property. He is in custody since 22.09.2016.
Patna High Court Cr.Misc. No.9587 of 2017 (3) dt.25-04-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of the fact one blood stained petticoat and one blood stained sac of cement were found in the house of the petitioner, as such, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail before the court concerned, after framing of charge in this case, which will be considered on its own merit without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
