03-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No. 57 of 2025, registered for the offence punishable under Section 140(3), 279, 125, 103(1), 238 and 3(5) of B.N.S., 2023.
3. As per the prosecution case, the informant has stated that on 19.01.2025 in the night, her son, namely Ajit Kumar had gone out to take meal at the house of Suresh Rai (petitioner). On 21.01.2025, in the morning, she received a news that his son was not there and despite hectic search, he could not be traced and thereafter, F.I.R. was lodged against unknown.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Name of the
Patna High Court CR. MISC. No.57298 of 2025(3) dt.03-12-2025 2/2 petitioner has surfaced during course of investigation in the confessional statement of co-accused Sunil Paswan, who has already been granted bail by a coordinate Bench of this Court, vide order dated 20.05.2025 passed in Cr.Misc. No. 31856 of 2025. There is no direct / indirect evidence against this petitioner to show his complicity in the alleged occurrence. Petitioner is in custody since 26.05.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the nature of accusation and period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 57 of 2025.
