This application, for grant of anticipatory bail, arises out of Chhatapur P.S. Case No. 139 of 2016, disclosing offences under Sections 147, 341, 323, 353 and 504 of the Indian Penal Code. It has been submitted on behalf of the petitioner that only general and omnibus allegations have been made against the petitioner and other co-accused persons of this case have already been granted bail by this Court vide order, dated 04.10.2016, passed in Criminal Miscellaneous No. 42184 of 2016 Having heard both sides and considering the facts and circumstances of the case and the fact that other co-accused persons have already been granted the privilege of bail, this application is allowed. Let the petitioner, above named, in the
Patna High Court Cr.Misc. No.49569 of 2016 (2) dt.14-12-2016 2/2 event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul, in connection with Chhatapur P.S. Case No. 139 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
