Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, these petitioners along with other FIR named accused persons are alleged to have assaulted the informant and his son.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. The FIR has been lodged after five days of the occurrence which makes the prosecution case doubtful. Both

Patna High Court CR. MISC. No.64960 of 2021(4) dt.17-10-2022 2/2 parties are Gotias and the occurrence took place on account of land dispute between them. The injuries sustained by the injured are simple in nature.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and nature of accusation against the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bikramganj, Rohtas in connection with Bikramganj PS case No. 317/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
