====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-10-2019 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners apprehend their arrest in connection with Complaint Case No. 5387 (C) of 2018 in which cognizance has been taken under Sections 341, 323, 354, 354(A), 504, 506, read with 149 IPC.

The allegation against the petitioners is that the

Patna High Court CR. MISC. No.62892 of 2019(2) dt.23-10-2019 2/3 petitioners along with other accused persons used to tease the complainant and her daughter. It has further been alleged that the accused persons entered into the house of complainant and tried to outrage her modesty.

Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case due to oblique motive inasmuch as there is a dispute of passage between accused no. 1 Sanjeet Kumar Singh and the complainant and the petitioners are own cousins of Sanjeet Kumar Singh. Learned counsel further submits that prior to lodging of this complaint accused no. 1 Sanjeet Kumar Singh has lodged a complaint against the complainant which was converted into an FIR on 11.06.2018 stating therein that the complainant and other accused persons damaged the car of the accused no. 1 Sanjeet Kumar Singh standing near the passage. Learned counsel further submits that the accused no. 1 Sanjeet Kumar has been granted bail by this Court in Criminal Miscellaneous No. 40596 of 2019.

Having regard to the submissions made by the parties and taking into consideration the fact that there appears to be previous dispute in the parties and accused no. 1 Sanjeect Kumar Singh has been granted bail by this Court, I am inclined

Accordingly, the petitioners, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sh. Manish Kumar J.M 1st Class Patna, in connection with Complaint Case No. 5387 (C) of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
