The petitioner is accused in connection with Jamui P.S. Case No. 39 of 2017, registered under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of Chief Judicial Magistrate, Jamui. The accusation of informant is that her son, Md. Khurshid and one Md. Raja were accompanied by the petitioner from her house on 10.02.2017. After half hour, informant received information that her son and his friend Md. Raja have been killed, sustaining gun shot injury. Informant raised suspicion about committing murder of his son and his friend Md. Raja by the petitioner under conspiracy of Rocky Singh and Anshu Singh. She

Patna High Court Cr.Misc. No.20961 of 2017 (3) dt.22-06-2017 further alleged that Md. Shamshad and Md. Shamshad had given money to this petitioner, Rocky Singh and Anshu Singh to kill her son and his friend Md. Raja.

Learned counsel for the petitioner submits that when petitioner along with the deceased moved from the village then Rocky Singh and Anshu Singh shot fire at the son of informant and Md. Raja and the petitioner also informed to the police and he was also apprehended from his house by the police. It is further submitted that co-accused, Md. Shamshad Alam, son of Md. Shahabuddin, and Md. Shamshad, son of Late Maulvi Barique, have already been granted privilege of bail by a Bench of this Court vide order dated 12.05.2017 passed in Criminal Misc. No. 21352 of 2017. Further submission is that petitioner has no criminal antecedent and is in custody since 12.02.2017. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
