The petitioner seeks bail in Sherghati P.S. Case No. 85 of 2016, registered for the offence punishable under Section 395 of the Indian Penal Code.
The petitioner is not named in the FIR. The informant lodged the case against unknown for looting his truck loaded with rice. The petitioner was apprehended and the police took his confessional statement.
Learned counsel for the petitioner submits that the police forcibly took the statement of the petitioner but, nothing has been recovered from the possession of the petitioner. Other accused persons namely Md. Afroz, Md. Saddam, Rajesh Sao and Rajesh Kumar Yadav have already been enlarged on bail by this

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sherghati, Gaya in Sherghati P.S.
