JUSTICE RAJIV ROY ORAL ORDER 23-01-2023 Heard Mrs. Namarta Mishra, learned counsel for the petitioners and Mr. Bharat Bhushan, learned APP for the State. The petitioners apprehend their arrest in connection with Madhubani (Town) P.S. Case No. 279 of 2022 for the offence registered under Sections 341, 323, 324, 307, 379, 354(B), 504, 506/34 of the Indian Penal Code.
As per the prosecution story, the informant alleged that when he came out of his house and was going for some important work, some water splashed over his co-villager, Prem Chand Thakur. Thereafter all the accused persons abused and assaulted the informant's side in which specific allegations have

Further, Vikash Thakur also assaulted him while Prem Chand Thakur assaulted the informant's mother. Mrs. Namrata Mishra, learned counsel for the petitioners submit that the omnibus allegations has come against the petitioners hearing and in a zeal to implicate all the family members, even the female inmates have not been left behind, petitioner no. 2 and 3 being ladies.
The last submission is that they do not have criminal antecedent.
Learned APP for the State opposes the prayer for bail. Considering the aforesaid facts that the specific allegation has come against the named accused persons, as stated above, none of the petitioners are amongst said accused, they do not have criminal antecedent, ultimately they will have to face the trial, this Court is inclined to grant the privilege of anticipatory bail.
In the aforesaid circumstances the petitioners, in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned
