The petitioner seeks bail in connection with Phulwariya P.S. Case No. 27 of 2016, registered under Sections 341, 323, 448 and 307 of the Indian Penal Code. The allegation of informant, namely, Budhia Devi is that on 23.03.2016 Hari Sah, husband of the informant was doing breakfast at his house at that time petitioner reached there and with intention to kill him gave scissor blow at the neck of her husband, thereafter he fell down. On hulla, the villagers rushed there and husband of the informant was rushed for treatment to Phulwaria Hospital from where he was referred to Sadar Hospital, Gopalganj and thereafter he was referred to Gorakhpur.

Patna High Court Cr.Misc. No.13473 of 2017 (3) dt.26-04-2017 2/2 Learned counsel for the petitioner submits that it would appear from the injury report that there is no repetition of blow. Further submission is that while two injuries were found on the person of Hari Sah, husband of the informant, one lacerated wound on middle finger of left hand and other incised wound 1 1⁄2 X 1/4" muscle deep on let side of neck caused by sharp object, but nature of injury has not been detailed. Further submission is that petitioner has no criminal antecedent is in custody since 26.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 3rd Addl. Sessions Judge, Gopalganj in connection with Phulwariya P.S. Case No. 27 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
