Petitioner seeks bail in a case registered under Section 30 (a) of Bihar Prohibition and Excise Act, 2016. On alleged recovery of 5 liters of country made liquor from a bag on a motorcycle which the petitioner is alleged to be travelling on, he has been in custody since 26.06.2019. It is submitted that in the other case arising out of Sheikhpura Police Station Case No 138 of 2019, on similar allegations, petitioner has already been allowed privilege of bail.

Having considered the submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand)

Patna High Court CR. MISC. No.51899 of 2019(3) dt.30-09-2019 2/2 with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Sheikhpura in Excise Case No 201 of 2019 arising out of Sheikhpura Police Station Case No 295 of 2019 with the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
