JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 8/17(c )/18(c ) of the NDPS Act.

As per the prosecution case, 4.5 kg of opium has been recovered from the co-accused, who disclosed the name of this petitioner as one of their associates indulged in illegal trade of opium.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner has got clean antecedent.

No.64606 of 2021(3) dt.11-08-2022 2/2 Learned counsel appearing for the State opposes the prayer for anticipatory bail and submitted that huge quantity of opium has been recovered from the possession of co-accused, who disclosed the name of this petitioner as one of their associates who is also indulged in illegal trade of opium. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
