This is repeat application seeking bail in connection with Jakkanpur P.S. case no. 21 of 2016, registered under Section 3⁄4 of the Explosive Substance Act.
Earlier the petitioner had moved this Court for bail which was considered and rejected under order dated 11.11.2016 observing as under:- "Considering the allegations and other materials reflected from the record, I am not persuaded to extend the privilege of bail to the petitioner. Rejected.
However, the petitioner is granted liberty to renew prayer for bail after five months."
Learned counsel submits that co-accused Sourabh Kumar Gupta @Sourabh @ Saurabh Kumar has since been
Patna High Court Cr.Misc. No.22569 of 2017 (2) dt.21-06-2017 2/2 granted the privilege of bail by this Court under order dated 04.02.2017 passed in Cr. Misc. No. 2241 of 2017.The petitioner has no criminal antecedents. He is in custody since 05.02.2016. Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. Let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IX, Patna in connection with Jakkanpur P.S. case No. 21 of 2016, subject to the following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.
(ii) No sooner the charges are framed the petitioner shall continue to appear before the Court below in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
