1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 1 is a woman and the informant alleges that accused persons including the petitioners came on 07.04.2024 variously armed while informant was working on his land and started abusing, further on orders of Kayamuddin, accused Riyaz assaulted him by knife causing injury on head, further Seraj assaulted his

Patna High Court CR. MISC. No.59163 of 2024(2) dt.20-08-2024 2/3 brother Sikandar by an iron rod causing injury on head, it is next alleged that Ajma Begum assaulted him by lathi causing swelling on hand, further petitioner no. 2 and Arbaj assaulted Sikandar by lathi on his body when he fell.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case. It is next submitted that though it is alleged that on orders of Kayamuddin, Riyaz assaulted the informant by knife, but then the injury suffered is simple in nature caused by hard and blunt substance. It is further submitted that the injury report belies the allegation of assault by knife. It is further submitted that petitioner no. 1 is a woman and is a senior citizen and has been implicated with general and omnibus allegation. The learned counsel submits that the allegation against the petitioners of assault is general and omnibus in nature.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.59163 of 2024(2) dt.20-08-2024 3/3 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Buxar (Industrial) P.S. Case No. 71 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

7. Accordingly, the instant anticipatory bail application stands allowed.
