JUSTICE SHAILENDRA SINGH ORAL ORDER 27-11-2025 While pointing out defect no. 70, it is submitted by the petitioner's counsel that the instant writ petition has been filed for compliance of this court's earlier order dated 03.10.2016 passed in CWJC No. 17333/ 2014 for which the petitioner has a remedy by way of filing contempt petition against the erring Circle Officer as several years have passed after the order dated 03.10.2016 and the petitioner made several attempts to get that order complied by the concerned Circle Officer and when he failed, he filed this writ petition, however, he is ready to file MJC petition for getting the order dated 03.10.2016 complied by initiating contempt proceeding against the erring Circle Officer, so, he wants to withdraw this writ
Patna High Court CWJC No.19410 of 2021(4) dt.27-11-2025 2/2 petition with a liberty to file MJC petition.
2. Considering the aforesaid submission, the instant writ petition stands disposed of as withdrawn with giving aforesaid liberty to the petitioner and the delay in filing the MJC will be looked into in the light of the previous attempts of the petitioner to get the order dated 03.10.2016 complied.
