====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 14-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is languishing in custody since 13.06.2019 in a case for the offence registered under Sections 457, 380 and 511 of the IPC.
The prosecution story, in brief, is that on 12.06.2019 at about 12.30 hours in the night, the informant Pradeep Paswan was sleeping with his family after taking meal. He awoke up on the alleged date and time of occurrence after hearing the sound of Khat-Khat and found 3-4 persons were entered in his house taking ornaments and other articles after opening his boxes. On raising alarm, by the informant, they tried to escape but on the arrival of his brother and other persons of village, all four thieves were apprehended who are Vinay Paswan, Arvind

No.50421 of 2019(2) dt.14-08-2019 2/2 Pandey, Lav Kush Singh and Chandan Mahto (petitioner) It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Due to previous enmity, the petitioner has been made accused in the present case. There is no recovery of any stolen property from possession of the petitioner.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Bikramganj, Rohtas, in connection with Surajpura P.S. Case No. 92 of 2019.
