The petitioner seeks bail in Narpatganj P.S. Case No. 85 of 2017 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The SHO of Narpatganj police station alleged that one Arun Paswan was apprehended and from whose possession arms and ammunition was recovered. On the basis of confession of Arun Paswan the stolen motorcycle was recovered. It is alleged that Md. Iliyas was apprehended with the stolen motorcycle but while he was being taken to police station the petitioner and others surrounded and assaulted the police party.

Learned counsel for the petitioner submits that the petitioner is named at serial no. 79. No specific allegation of

Patna High Court Cr.Misc. No.21362 of 2017 (3) dt.19-06-2017 2/2 assault is made against the petitioner. Similarly situated coaccused persons have already been enlarged on bail. The petitioner is in jail since 17.03.2017.

Considering the facts aforesaid and the fact that no specific allegation is made against the petitioner and the petitioner is in jail for more than three months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Narpatganj P.S. Case No. 85 of 2017.
