In this case the petitioner is making a prayer the amount which is outstanding in the account of her husband vide saving account no. 11302572996 be transferred to her pension account no. 31068113574.

A counter affidavit has been filed by the Bank, wherein, in paragraph no.5, details have been given for formalities which the petitioner has to fulfill and, thus, she will have to furnish the genealogical table as with regard to legal heirs of her husband, the

Patna High Court CWJC No.8949 of 2015 dt.01-09-2017 Indemnity Bond, the revised claim format, the disclaimer petition of the legal heirs of her husband, the affidavit etc. on the prescribed format of the Bank.

If the petitioner fulfills all the aforesaid formalities as mentioned in paragraph no.5 of the counter affidavit, the Bank will take care that the money should be transferred into the pension account of the petitioner.

So far this Court cannot give direction for bypassing the formalities which are required for her to comply with and, as such, let the petitioner should comply all the formalities within a period of one month. If the petitioner complies all the formalities within the aforesaid period of one month, it goes without saying that the money will be transferred to her pension account within a period of one month thereafter.

With the aforementioned observation and direction, this application is disposed of.
