The petitioner seeks bail in anticipation of his arrest in connection with Phulwaria P.S. Case No. 05 of 2017 dated 04.01.2017 instituted for the offence under Section 379 of the Indian Penal Code.
The name of the petitioner has transpired in the confession of a co-accused viz. Sanjay Sahani. The motorcycle of the informant was stolen.
Learned counsel for the petitioner has submitted that there is no recovery from his possession and his name has wrongly been taken by the coaccused. In that context, the learned counsel for the petitioner has further submitted that earlier also, on the statement of Sanjay Sahani, he was made accused in
Patna High Court Cr.Misc. No.25604 of 2018(2) dt.04-05-2018 2/2 Phulwariya P.S. Case No. 37 of 2017 under Section 414 of the I.P.C. In the aforesaid case, he has been granted anticipatory bail. Apart from the present case and Phulwariya P.S. Case No. 37 of 2017, there is no other case pending against the petitioner.
For the facts stated above the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIII, Gopalganj in connection with Phulwariya P.S. Case No. 05 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
