JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Gopalganj Town P.S. Case No. 297 of 2017 dated 12.07.2017 instituted for the offence under Sections 414/34 of the Indian Penal Code.
Three persons were spotted by the Police Party driving a motorcycle which was suspected to be a stolen one. Two of the miscreants managed to escape. One Dhananjay Kumar Singh was arrested who disclosed the name of the petitioner as well and further stated that he along with his accomplices are involved in sale and purchase of the stolen motorcycles. The learned counsel for the petitioner has submitted that but for the confession of the co-accused viz. Dhananjay Kumar Singh, there is no other material to connect the
Patna High Court Cr.Misc. No.24605 of 2018 (2) dt.25-04-2018 2/2 petitioner with the crime. That apart, it has been submitted, the vehicle is not reported to be stolen one as no case has been lodged with respect to the theft of the vehicle in question. Under similar circumstances, one Rakesh Kumar Singh, who is also stated to have managed his escape along with the petitioner, has been granted anticipatory bail by a Bench of this Court vide order dated 21.12.2017 passed in Cr. Misc. No. 62554 of 2017.
The petitioner does not have any criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 297 of 2017.
