The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) / 41(1) of Bihar Prohibition and Excise Act.

207 liters of Nepali liquor has been recovered from a sack, which was recovered from co-accused Mukesh Kumar. Name of the petitioner transpired on the basis of confessional statement of co-accused Mukesh Kumar. Nothing has been recovered from conscious possession of the petitioner. Petitioner claims clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the

Patna High Court CR. MISC. No.56529 of 2022(2) dt.02-12-2022 2/2 event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No.-I, East Champaran, Motihari in connection with Kundwa Chainpur P.S. Case No. 278 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
