JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-05-2018 The petitioners seek bail in anticipation of their arrest in connection with Gwalpara P.S. Case No. 173 of 2017 dated 11.12.2017 instituted for the offences under Sections 341, 448, 427, 323, 379, 504, 506, 34 of the Indian Penal Code. The petitioners and others are said to have entered into the house of the informant, ransacked the same and also demanded ransom money of Rs. 1,00,000/-(one lakh). The mother and grand-mother of the informant was also attempted to be disrobed.

The learned counsel for the petitioners has submitted that no reason has been assigned in the F.I.R for the

Patna High Court Cr.Misc. No.25556 of 2018 (2) dt.03-05-2018 2/2 petitioners to commit such an offence. On the contrary, it has been argued that the present case has been lodged only because of the land dispute between the parties. Two Title Suits vide Title Suit Nos. 170 of 211 and 540 of 2016 between the parties are pending adjudication by the competent Court of law. That apart, it has been submitted that the F.I.R has been lodged after two days of the occurrence.

The petitioners do not have any criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Udakishunganj, Madhepura in connection with Gwalpara P.S.
