1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)9a), 26 and 35 of the Arms Act.

3. As per the prosecution case, on secret information a raid was conducted and four accused were apprehended with arm and ammunition who disclosed the name of the petitioner.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the possession of the petitioner and has been made accused only on the basis of confessional statement of co-accused who was arrested on the spot.

5. Learned counsel appearing for the State has also opposed the bail prayer of the petitioner.

6. Considering the facts and circumstances of this case as well as above submissions advanced by petitioner's counsel, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Garhi P.S. Case No. 49 of 2022 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
