The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Darbhanga Sadar P.S. Case No. 489 of 2018 registered for the offence punishable under Sections 302/120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding the accused persons having killed the brother of the informant by shooting him as a result whereof the deceased received gun shot injury and subsequently died.

The learned counsel for the petitioner has submitted that the petitioner is not an FIR named accused person and his name has

No.50141 of 2019(3) dt.30-09-2019 2/2 transpired in the present case on account of the confessional statement given by the co-accued persons, namely, Neeraj Kumar and Rupesh Kumar Singh, who have already been granted bail by a coordinte Bench of this Court vide order dated 08.07.2019 and 08.08.2019 passed in Criminal Misc. No. 24063 of 2019 and Criminal Misc. No. 49501 of 2019. It is further submitted that though the petitioner is accused in one other case but he is on bail in the said case and is languishing in custody since 30.01.2019.

Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S. Case No. 489 of 2018.
