====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-10-2024 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioners apprehend their arrest in connection
Patna High Court CR. MISC. No.62243 of 2024(2) dt.01-10-2024 2/3 with Jamui P.S. Case No. 04 of 2024 registered under Sections 341, 323, 307, 379, 325, 147, 148 and 149 of the Indian Penal Code.
3. As per prosecution case, on the alleged date and time of occurrence, all the F.I.R. named accused persons including these petitioners assaulted informant and his cousin brother. On account of which, they sustained injuries. It is further alleged that petitioner no. 11 snatched Rs. 30,000/- from the pocket of informant and also snatched gold chain from neck of his cousin brother.
4. Learned counsel appearing on behalf of the petitioners submits that both parties are gotiya and due to land dispute, a free-fight took place between them, in which both sides sustained injuries. Case and counter case. Specific accusation of assault is against co-accused Kantu Sao.
5. Learned counsels for the State and the informant opposed the bail application and submits that petitioners are named in the First Information Report. There is specific allegation of assault against these petitioners.
6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the
Patna High Court CR. MISC. No.62243 of 2024(2) dt.01-10-2024 3/3 learned court below within a period of eight weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 04 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
