2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.
3. As per the prosecution case, the Ex-Manager of the Madhya Gramin Bank, Baidrabad is alleged to have committed irregularity in sanctioning/distributing the bank loan on the basis of forged and fabricated Land Possession Certificate in his tenure. It is further alleged that Ex-Manager and 121 beneficiaries are involved in the alleged fraud and they have committed misappropriation of government money of Rs. 2,48,33,646.94.
4. It is submitted by the counsel for petitioner that
Patna High Court CR. MISC. No.55559 of 2023(2) dt.09-10-2023 2/2 petitioner has been falsely implicated in this case. Petitioner is not named in the FIR, but he is one of the beneficiary who availed the bank loan by presenting forged documents. Moreover, petitioner has already deposited the loan amount, thereafter, bank has issued No Dues Certificate. Petitioner claims clean antecedent.
5. learned APP for the State vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the petitioner above-named, be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Arwal, Jehanabad in connection with Arwal P.S. Case No. 109 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
