The petitioner is accused in connection with Nawkothi P.S. Case No. 58 of 2015 arising out of POCSO Case No. 55 of 2015, registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is of enticing away the minor daughter of informant by this petitioner with the help of Ram Binod Mahto, Bablu Mahto, Laxman Mahto, Rajmahal Devi and Manu Mahto with intention to perform the marriage.

Learned counsel for the petitioner submits that there was love affair in between the petitioner and the victim, daughter

No.20947 of 2017 (3) dt.22-06-2017 of informant, and she left her house according to her own sweet will and reached at Begusarai Railway Station, from where, petitioner and the daughter of informant boarded on train and reached at Karnal. After three days, daughter of informant talked to her aunt on mobile. It is further submitted that in the medical examination, the age of the victim has been assessed in between 15 to 17 years and the petitioner is in custody since 01.07.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Session Judge -I-Cum- Special Judge (POCSO Act), Begusarai, in connection with Nawkothi P.S. Case No. 58 of 2015 arising out of POCSO Case No. 55 of 2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
