JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-11-2019 The petitioner, who is in custody since 03.05.2019, seeks bail in connection with Chhapra Mufassil P.S. Case No. 316 of 2018, dated 05.08.2018, instituted for the offences under Sections 395 and 397 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted on behalf of the petitioner that he has not been named in the F.I.R. and his implication in this case has only on the basis of confession of an

Patna High Court CR. MISC. No.50500 of 2019(3) dt.16-11-2019 2/2 arrested accused persons. There is no recovery from the possession of the petitioner and he has also not been put on test identification parade.

Similarly situated co-accused person is also said to have been granted bail by a co-ordinate Bench of this Court. Considering the aforestated facts, the petitioner abovenamed is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran in connection with Chhapra Mufassil P.S. Case No. 316 of 2018.

The application stands allowed.
