The petitioner is languishing in custody since 04.12.2015 in connection with Punpun P.S. Case No. 269 of 2015 for the offences instituted under Sections 147, 148, 149, 307, 506, 302 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that the petitioner had killed the father of the informant due to land dispute. Earlier the bail application of the petitioner was rejected vide Cr. Misc. No. 26322 of 2016 taking into account that the petitioner had fired on the chest of the deceased. This is second attempt on behalf of the petitioner for grant of bail.

Patna High Court Cr.Misc. No.17593 of 2017 (3) dt.19-07-2017 2/2 A report was called for from the court below regarding the stage of the case. It has been reported that the case has been committed to the Court of Sessions. . Considering the allegation and the accusation made against the petitioner, I am not inclined to grant bail to the petitioner. The same is rejected in Punpun P.S. Case No. 269 of 2015, pending in the court of the learned S.D.J.M. Masaurhi, Patna.

Anyhow, the learned court below is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of receipt/production of copy of the order.

The District Magistrate, Patna and the Senior Superintendent of Police, Patna are directed to ensure that the prosecution witnesses are produced in the court on the date fixed by the court below so that the trial could be concluded within the stipulated period.
